Chapter 1. General rules 1.Object The terms of use is aimed at regulating conditions of the use, procedures and other matters of internet-related services (hereafter the "services" or "organization") which are provided by InKAS.or.kr that is operated by International Korean Adoptees Service Inc. (hereafter the organization). 2.The effectiveness of the terms of use The terms of use take effect by being posted on the homepage of the services. 3.Posting and changing the terms of use The services can change the terms of use. The changed terms take effect by announcement or notification in a way early mentioned earlier on in the terms of use 2. 4.Rules other than the terms of use Matters which are not stated on in the terms of use shall be placed under the basic act of electrical communication, the act of electrical communication business, the basic act of electronic commerce, the act of electronic autograph and other related rules. Chapter 2. Member registration and use of services 1.Definition of members A member refers to an individual who is accepted as a member by the organization. The member shall agree to the terms of use, fill out the registration form and receive an ID and a password. 2.Joining the services (1)Joining the services is completed by the services' acceptance of a user's application and the user's agreement on the terms of use. (2)Those who want to join the membership and use the services shall provide the corporation with required personal information. (3)In a case where the organization accepts a user's application for the membership, the services shall notify the user of a member ID and other matters considered deemed necessary by the organization. (4) An ID can not be changed when after a user joins the services. For one each person, only one ID is provided. (5) The services shall not allow applications in the following cases: a.a user has used other person's name; b.a user has not signed up with his or her real name; c.an application form contains false information; d.a user has signed up for the services in order to undermine the public order or public morals. 3.Contents of the services (1)The services shall provide services such as: 1.Documents, photos and multimedia data services; 2.Online sponsorship, community services; 3.Newsletter e-mailing services (2)The services are able to add or modify the contents of the services, if necessary. 4. The use of and restriction on the services (1)The use of services is available 24 hours a day, unless it is used by the organization for business purpose or technical problems. However, an exception will be made in a case where a previous notification is not available due to discontinuance of the services (disc disorder or system break-down which have nothing to do with intention of or mistakes by system managers) which has are caused by uncontrollable conditions. (2)The service hour mentioned on the previous article can change after prior notification, if the organization needs such changes for some reasons such as regular inspection of the system. 5. Fees for the services (1)The services are available for all members free of charge. (2)If the services would provide fee-charging services, the former shall make an announcement in advance about the time, policies and prices related to fee charging services. Chapter 3. Secession from and rejoining the services and restriction on the use 1.Secession from the services If a user wants wishes to terminate their membership, it is possible to terminate the membership by using following the steps outlined in the Membership Ttermination section on the website. 2.Restriction on the use of services The services can may terminate a contract of use or stop the use of services without previous notice, if a member has committed a the following act or following acts: a.Acts against the public order or morals; b.Acts related to a crime; c.Planning or conducting the use of services in order to undermine the national or public interest; d.Stealing other person's ID and/or password; e.Defamation of character; f.Double registration by one person; g.Undermining the sound use of services such as doing harm to the services; h.Violation of the terms of use or of other related rules.; i.Using information acquired from the services for duplication, publication, broadcasting or in order to provide it for a third party without previous consent by the corporation (should it be services?). Chapter 4. Obligation 1.Obligation of the services (1)The services shall allow its members to use its services, unless the organization has special reasons (2)The services have has a duty to provide services in a continuous and stable manner according to the terms of use. (3)The services shall go through proper procedures in the matter of opinions expressed by its members. If the procedures take some amount of time, the services shall notify its members of the reason and procedure schedules. 2.obligation on protection of personal information (1)All the responsibility related to managing a member's ID and password belongs to the member. (2)Members shall agree with receiving the services' e-mails which are sent as part of the services. (3)If his or her ID has been used wronglyimproperly, the member shall notify the service of such fact of the organization. (4)The services shall not sell or offer personal information to a third party which has nothing to do with theare not affiliated with the organization without a user's previous consent. However, the organization can use the information which has been voluntarily provided in the following cases: a.Providing developers with the information which is required for the development of new functions, data and services useful for members. b.Providing advertisers with statistical data about members and user groups (which never show members' individual identities). c.Providing advertisement or services according to interests of its members. (5)Information which discloses a member's identity can be voluntarily open to the public on the donation section such as the bulletin board and data board (hereafter the donation section). In this case, the information can be collected and used by a third party and a member could receive unsolicited messages. Such acts conducted by a third party cannot be controlled by the organization. Therefore, the corporation is not responsible for the possible use of members' information by a third party which cannot be controlled by the organization. (6)The corporation can provide information about its members for organizations that the former has partnership with or use the information with them. 3.Exemption clause (1)The services does not provide its services if it cannot provide services due to natural disasters or acts of gGod. (2)The services are not responsible for a problem occurred in the use of services which is attributable to members. (3)The services are not responsible for a problem caused by incorrect information provided by its members. (4)The services are not responsible for the failure of providing expected benefits for its members or for damages arisen from the choice or use of the services' data. Chapter 5. dispute settlement (1)Except for matters stipulated on in the terms of use, other disputes regarding the use of services shall be resolved by mutual agreement as far as possible. (2)In a case where a lawsuit is filed because of a dispute regarding the use of services, the lawsuit falls under the jurisdiction of a court which controls the location of the corporation. Chapter 6. the use of donations (1)Ddonations are spent on programs which support adoptees abroad and adoptive families through International Korean Adoptees Service. (2)The details of the use of donations shall be open to the public through Annual Report or mails. [additional clause] The terms of service will take effect from on December 26th, 2008.
